Terms of Service

Agreement to terms
By creating an account or using Yapper (the "Service"), you agree to these Terms of Service. The Service is operated by JPM Inc. ("Yapper," "we," "us"). If you do not agree to these terms, do not use the Service.
What Yapper does
Yapper is an AI-powered phone receptionist for small businesses. You forward your business calls to a phone number we provision for you. Our AI answers those calls, handles common inquiries based on information you provide about your business, and sends you summaries after each call. Yapper is a tool to help you manage calls. It is not a substitute for professional advice, emergency services, or licensed human operators.
Accounts
You need an account to use Yapper. When you sign up, you agree to:
- Provide accurate information about yourself and your business
- Keep your login credentials secure
- Notify us if you believe your account has been compromised
- Accept responsibility for all activity under your account
Each account is limited to one business. You may not create multiple accounts to circumvent usage limits or billing.
Free trial and billing
Yapper offers a 7-day free trial. No credit card is required to start. After the trial ends, you need to subscribe to a paid plan to continue using the Service.
Paid plans are billed monthly through Stripe. Prices are listed on our pricing page and may change with 30 days notice. Each plan includes a set number of minutes per month. Usage beyond your plan's included minutes may result in overage charges or service limits, which we will communicate before they take effect.
You can cancel your subscription at any time through the billing page in your dashboard. Cancellation takes effect at the end of your current billing cycle. We do not offer prorated refunds for partial months.
Acceptable use
You agree not to use Yapper to:
- Operate any business or activity that is illegal in your jurisdiction
- Mislead callers about the nature of the AI (where disclosure is required by law)
- Record calls in violation of applicable wiretapping or consent laws
- Harass, threaten, or defraud callers through the AI receptionist
- Reverse-engineer, exploit, or interfere with the Service or its infrastructure
- Resell or redistribute the Service without written permission
- Use the Service to make outbound calls or for telemarketing
We reserve the right to suspend or terminate accounts that violate these terms.
Your responsibilities
As a Yapper user, you are responsible for:
- Making sure the business information you provide is accurate and up to date
- Reviewing call summaries and transcripts for accuracy before acting on them
- Complying with all laws that apply to your business, including call recording and AI disclosure laws in your state or country
- Configuring your AI greeting to inform callers they are speaking with an automated system, where required by law
- Maintaining your own backup communication channels for emergencies
AI limitations
Yapper uses artificial intelligence to handle phone calls. You should understand that:
- The AI may occasionally misunderstand callers, provide incorrect information, or generate inaccurate transcripts and summaries
- The AI cannot replace professional judgment in medical, legal, or financial matters
- The AI is not a substitute for emergency services (911)
- Call quality depends on the caller's phone connection and speaking clarity
- Website scraping during onboarding may not perfectly capture all of your business details, which is why we give you a review screen to correct any errors
You are responsible for verifying any information the AI provides to your callers.
Service availability
We aim to keep Yapper running 24/7, but we do not guarantee uninterrupted service. Downtime can happen due to maintenance, third-party provider outages (Retell AI, Twilio, Supabase, Stripe, Vercel), or circumstances outside our control. We are not liable for missed calls, lost business, or damages resulting from service interruptions.
Intellectual property
Yapper's branding, design, code, and AI prompts are the property of JPM Inc. You retain ownership of your business data, call records, and any content you provide. By using the Service, you grant us a limited license to use your business information solely for the purpose of operating the AI receptionist on your behalf.
Termination
You can close your account at any time by canceling your subscription and emailing us at hello@tryyapper.com to request account deletion. We will delete your data within 30 days of the request.
We may suspend or terminate your account if you violate these terms, use the Service for illegal purposes, or fail to pay for your subscription. If we terminate your account, we will attempt to notify you by email with a reason.
Limitation of liability
To the maximum extent allowed by law, JPM Inc. is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. This includes but is not limited to lost revenue, missed calls, inaccurate AI responses, data loss, or service interruptions. Our total liability for any claim related to the Service is limited to the amount you paid us in the 3 months before the claim arose.
Indemnification
You agree to indemnify and hold harmless JPM Inc. from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your failure to comply with applicable laws, including call recording and AI disclosure requirements.
Governing law
These terms are governed by the laws of the State of Michigan, United States. Any disputes will be resolved in the state or federal courts located in Michigan.
Changes to these terms
We may update these Terms of Service from time to time. If we make significant changes, we will notify you by email or through the dashboard. Continued use of the Service after changes take effect means you accept the updated terms.
